(“Administrator”), and their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Sponsor and its Administrators”), and its affiliates and each of their respective employees, shareholders, directors, officers, members, assigns, and agents, and their immediate family members and/or those living in the same household of each are not eligible to participate or win. Void where prohibited by law. Promotion is subject to all applicable federal, state, and local laws.
HOW TO ENTER FOR THE CONTEST: During the Promotion Period, Nominators may enter the Promotion by visiting CVSHomeTeamHeroes.com (“Site”) and completing the online entry form, including sharing the name of their child/charge who is seven (7) to fifteen (15) years of age (at the time of entry) and is an active soccer player to nominate (“Nominee” or “Child”) and answering the following questions: “How is your child helping make a difference in the community?”; “How has soccer shaped who your child is on and off the field?”; and “What does being crowned a ‘Home Team Hero’ mean to your child and their community?” in two hundred fifty (250) words or less per question. Then, Nominators must upload three (3) recent photos (2 soccer participation photos and 1 community involvement photo) of their Nominee (“Submission”) to receive one (1) entry (“Entry”). Each eligible Submission received during the Promotion Period will constitute one (1) Entry into the Contest.
Limit of one (1) Entry per Child. If a Nominator has more than one Child that is eligible, they may submit up to one (1) Entry for each Child. Only one (1) Child may be featured in each Submission. Entries in excess of that limit will be disqualified if discovered by Sponsor. Entries must be in English. The person uploading the Entry will be deemed the nominator (“Nominator” or “Entrant”). In the event of a dispute as to the identity of a Nominator, the authorized account holder of the email address used to enter will be deemed to be the Nominator. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or business, educational, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Any Entry not in compliance with the above and which does not meet the other requirements of these Official Rules will be disqualified. Participation is subject to disqualification of all Entries, if Sponsor and its Administrators discover that multiple accounts are used by the same person. As applicable, normal Internet/phone access and usage/data charges imposed by Nominators’ online/mobile service will apply.
ENTRY REQUIREMENTS: By submitting an Entry, each Nominator represents and warrants that: (a) they are the parent or legal guardian of the Nominee identified in the Entry; (b) they have all rights, permissions, and authority necessary to submit the Entry and grant the rights described herein; and (c) the Entry complies with these Official Rules. Nominators must make Nominees and their soccer organization aware that they are submitting an Entry on their behalf. By entering, Nominators agree to waive any rights they may have to the Entry submitted. The Entry, or portion thereof, may not contain obscene, profane, lewd, defamatory, or inappropriate content, or be disparaging to Sponsor, as determined in Sponsor’s sole discretion. Entries must be in keeping with Sponsor's image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. Nominators may not copy or otherwise plagiarize the Entry from any source. All Entries must be the sole, original work of the Nominators. Any Entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, inappropriate, disparaging, offensive, or contains proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Nominator. Entries should not contain any third-party materials (other than Sponsor-owned or associated with their soccer organization), or otherwise violate or infringe (or possibly infringe) any copyright, trademark, logo, or mark that identifies a brand. Entries become the property of the Sponsor and will not be acknowledged or returned. Nominators acknowledge and agree that their Entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote, and otherwise use Entries in any way it sees fit. Automated, script, macro, or robotic Entries submitted by individuals will be disqualified. Entries may be posted on the Sponsor’s social media sites, and may be posted on other websites, in Sponsor’s sole discretion. Any Entry not in compliance with the above and which does not meet the requirements of these Official Rules will be disqualified.
JUDGING: All Submissions will be judged by Sponsor-selected judges (“Judges”) between September 25 and November 1, based on the following criteria: Demonstrated Leadership (25%); Teamwork and Collaboration (25%); Sportsmanship and Character (25%); Positive Impact in Their Community (25%) (the “Judging Criteria”), to determine two (2) Grand Prize Entries and two (2) Runner Up Prize Entries. In applying the Judging Criteria, Judges may consider examples of leadership, teamwork, sportsmanship, character, and positive community impact, including, but not limited to:
Volunteering regularly with a nonprofit, school, or community organization;
Organizing or leading community improvement efforts;
Mentoring or supporting younger teammates, students, or community members;
Demonstrating leadership in school clubs, scouting organizations, youth councils, soccer teams, or similar programs;
Promoting inclusion, kindness, teamwork, or sportsmanship within a team, school, or community;
Participating in community service projects on a recurring basis;
Creating a project or initiative that addresses a local community need;
Supporting causes that improve the wellbeing of others through advocacy, awareness-building, or volunteer efforts;
Ongoing acts of service, volunteerism, or mentorship; and
Making a positive impact on peers through teamwork, sportsmanship, or inclusion.
Such examples are illustrative only and are not separate eligibility requirements. Any tied Submissions will be re-judged by the judges based solely on the Positive Impact in Their Community criterion. Judges’ decisions are final with respect to all matters relating to the Promotion. To ensure equitable evaluation across the eligible age range, judges will assess each Nominee's achievements, leadership, community impact, and character in light of the Nominee's age and circumstances. Entries will be evaluated based on the quality and significance of the Nominee's contributions relative to peers of a similar age rather than on the absolute magnitude of accomplishments alone. By participating, Nominators agree to the Official Rules and the decisions of the Judges, which shall be final and binding in all respects.
PRIZES AND APPROXIMATE RETAIL VALUES (“ARV”): Each prize package will include a monetary grant and additional non-grant awards. All grants will be directed to the Nominee’s soccer organization. Neither the Nominator nor the Nominee will receive any money or payment as part of the grant. To receive the grant, an authorized representative from the Nominee’s soccer organization must sign grant claim documents provided by Sponsor within the deadlines communicated to the Nominee’s soccer organization (as outlined in Rule 8 below). If the Nominee’s soccer organization does not respond or fails to respond within three (3) days of receipt of the initial notification, the Nominee’s soccer organization may be disqualified and an alternate recipient may be determined/selected.

A Block Party for the Nominee’s soccer team (“Block Party”)
The non-grant portion of the Grand Prize has a total ARV of $1,000. All details of the Block Party will be in Sponsor’s sole discretion, including venue and date/time. Sponsor will work with the Nominator of the Grand Prize Nominee to coordinate all details. All attendees of the Block Party (or parent/legal guardian on behalf of a minor attendee) may be required to sign a release form prior to attendance or at time of Block Party in order to attend the Block Party.
Runner-Up Prizes (2 available):

A signed soccer ball from a Sponsor-selected athlete awarded to the Nominee (ARV: $300 each).
The manner and form in which any Nominee is featured in promotional advertising will be determined by the Sponsor in its sole discretion. Sponsor has no obligation to use any Nominee in any advertising or promotional material. Limit one (1) prize per person/soccer organization. Prizes are non-transferable and no substitution is allowed except by the Sponsor. All aspects of the Prizes will be in Sponsor’s sole discretion. If applicable, all federal, state, and local taxes on the value of the grant are the responsibility of the winning Nominee’s soccer organization.
PRIZE RULES: No portion of the check will be paid directly to the Prize-winning Nominee, Nominator, or any individual. As a condition of prize acceptance, the selected Nominators [who are the corresponding Nominee's parent(s) or legal guardian(s)] may be required to execute additional releases, publicity consents, photography/video releases, appearance releases, and other documentation requested by Sponsor. Failure to execute such documentation within the time period specified by Sponsor may result in forfeiture of the prize. Prizes must be accepted as awarded and may not be separated, substituted, or partially accepted. Nominator of a potential Prize-winning Nominee (on behalf of the Nominee) and the authorized representative from the soccer organization must accept the entire prize package, including all components of the prize, in order for the Nominee to be confirmed as a winner. If a Nominator of a potential Prize-winning Nominee or the authorized representative from the soccer organization declines any portion of the prize, the prize will be forfeited in its entirety and may be awarded to an alternate winner, in Sponsor’s sole discretion.
By accepting a Prize, each Nominator agrees that the Sponsor and its designees may photograph, film, record, interview, and otherwise capture the Nominee’s name, image, likeness, voice, and appearance and their soccer organization’s name, image or likeness, in connection with the Promotion/photoshoot/campaign and any related activities (“Footage”). Such Footage may be used by Sponsor in connection with Sponsor’s products and services, including, without limitation, product packaging, in-store displays, point-of-sale materials, websites, social media, public relations materials, digital advertising, print advertising, video content, and other promotional materials. Winners will not be considered employees of the Sponsor and all features in the campaign are part of the prize.
Sponsor shall have sole discretion regarding the selection, editing, production, publication, display, distribution, and use of any Footage or other content featuring the winning Nominees. Sponsor does not guarantee that any Footage or content will be used, featured, published, or displayed in any particular manner, medium, quantity, geographic area, or duration, or at all.
Each Nominator/representative of the soccer organization further grants Sponsor a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid-up license, with the right to sublicense, to use, reproduce, modify, adapt, publish, create derivative works from, distribute, and display the Footage for any lawful purpose consistent with these Official Rules.
Sponsor shall have sole discretion regarding the content, format, design, duration, distribution, and use of any packaging, advertising, publicity, or promotional materials related to the prize featuring the Grand Prize-winning Nominees. Sponsor does not guarantee that any Grand Prize-winning Nominee’s image, likeness, first name, hometown, or other materials will be used for any particular length of time, in any particular medium, or at all.
All prize details not specifically stated herein shall be determined solely by Sponsor.
GENERAL: The Site’s computer timestamp is the official timekeeper for purposes of this Promotion. The Nominators of the potential Prize-winning Nominees will be required to sign and return a Declaration of Eligibility and Liability Release and, except where prohibited, publicity release and assignment of rights, as applicable (“Declaration”) within three (3) days of notification in order for their Nominee to be confirmed as a Grand or Runner-Up Prize winner. An authorized representative of the soccer organization where the Prize-winning Nominees are enrolled will need to sign and return a Declaration within three (3) days of notification for the Prize-winning Nominee’s soccer organization to be awarded the check. If the Nominator of a potential Prize-winning Nominee or the authorized representative from the soccer organization fail to return their completed Declaration within each such three (3) day response period, or any Declaration is returned as undeliverable, both the potential Prize-winning Nominator/Nominee shall be deemed to be ineligible, the Prize will be forfeited and an alternate potential Nominator will be determined. Both the Nominator of a potential Prize-winning Nominee and the authorized representative from the soccer organization must complete their applicable Declaration or the entire Prize will be forfeited and an alternate potential Nominator will be determined. Sponsor or Administrator will require the authorized representative of the soccer organization where the Prize-winning Nominees are enrolled to provide documentation reasonably acceptable to Sponsor demonstrating that it is organized and operating as a nonprofit organization. Acceptable documentation may include, but is not limited to, articles of incorporation, a certificate of incorporation or good standing issued by the applicable state, an IRS determination letter recognizing the organization's tax-exempt status, or other documentation deemed acceptable by Sponsor. Failure to provide satisfactory proof upon Sponsor's request may result in disqualification or forfeiture of the applicable Prize. Sponsor reserves the right to conduct a background check on the Nominator of the potential winning Nominees prior to awarding the prizes. Sponsor reserves the right in its sole discretion to disqualify any Nominator/Nominee based on the results of such background check, if Sponsor determines in its sole discretion that awarding the prize to such Entrant might reflect negatively on Sponsor. An Entrant is not a winner of a Prize unless and until Entrant's eligibility has been verified and Entrant has been notified that verification is complete. All Nominators on behalf of their Nominees, as a condition of entry into the Promotion/acceptance of prize, agree to release and hold harmless Sponsor and its Administrators, each of their respective agencies, parents, subsidiaries, affiliates and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of the Promotion (collectively the “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry, accepting a prize or otherwise participating in any aspect of the Promotion, the receipt, ownership or use of prize awarded, or any typographical or other error in these Official Rules, or the announcement or offering of the prizes. Winners/winning organizations assume all liability for any injury or damage caused, or claimed to be caused by participation in the Promotion or use or redemption of the prizes. Acceptance of a prize constitutes permission to use winners’ names, winning soccer organizations’ names, likenesses, Entries (if applicable), Submission (if applicable), and Footage (if applicable) for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By entering, Nominator accepts and agrees to be bound by these Official Rules. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Promotion; violates the Official Rules; acts in an unsportsmanlike or disruptive manner; or acts with intent to annoy, abuse, threaten, or harass any other person. The Released Parties are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in the Promotion which may limit the ability to participate, or by any human error which may occur in the processing of the Entries in the Promotion. Entries generated by script or bot are not eligible. Sponsor reserves the right to cancel, terminate, or modify the Promotion if it cannot be completed as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, Sponsor will determine the Grand Prize winners and Runner-Up Prize winners based on the Judging Criteria from eligible Entries received prior to cancellation as outlined above. As a condition of entering the Promotion or winning a prize, Nominator/Nominee agrees that: (a) under no circumstance will Nominator/Nominee be permitted to obtain awards for, and Nominator/Nominee hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; (b) all causes of action arising out of or connected with the Promotion, or prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event will Nominator/Nominee be entitled to receive attorneys’ fees or other legal costs.
NOMINATORS’ PERSONAL INFORMATION: Information collected from Nominators is subject to Sponsor’s Privacy Policy, located at https://www.cvs.com/retail/help/privacy_policy. Personal information collected through this contest will be used solely for contest administration, such as selecting contest winners and contacting submitters, and will only be retained through the duration of this campaign. EACH NOMINATOR WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND HEREBY IRREVOCABLY SUBMITS TO THE VENUE OF THOSE COURTS WITHIN THE STATE OF NEW YORK.
ARBITRATION PROVISION: By participating in this Promotion, each Entrant agrees: (i) that any and all disputes the Entrant may have with, or claims Entrant may have against, the Sponsor and its Administrators relating to, arising out of or connected in any way with (a) the Promotion, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (ii) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (iii) the arbitration shall be held in New York, New York; (iv) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable Entrant may have entered into in connection with the Promotion; (v) the arbitrator shall apply New York State law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (vi) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only Entrant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (vii) the arbitrator shall not have the power to award punitive damages against the Entrant or Sponsor; (viii) if the Entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of Entrant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (ix) with the exception of subpart (vi) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (vi) is found to be invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void, and neither Entrant nor Sponsor shall be entitled to arbitrate their dispute.
